Abstract

ABSTRACT JUDICIAL CONSIDERATION OF COPYRIGHT INFRINGEMENT ON THE SKETCH OF THE WELCOME MONUMENT IN JAKARTA AS A SILHOUETTE ON TREND COLOR SARI AYU PRODUCTS (CASE STUDY No. 465 K/Pdt.Sus-HKI/2024/PN.Jkt.Pst) By RZ M FEBRI AGUNG PT. Martina Berto, Tbk. faced a copyright infringement case involving the Welcome Monument sketch owned by the late Sena Meaya Ngantung. In 2018, PT. Martina Berto used the silhouette of the Welcome Monument sketch on its Trend Color Sari Ayu cosmetic products without the copyright holder’s permission. This act violated the copyright holder’s rights, prompting the copyright owner to file a lawsuit seeking compensation for material damages. The purpose of this study is to analyze the legal regulation of copyright in Indonesia, evaluate the legal liability for the infringement of the Welcome Monument sketch copyright, and identify the resolution of the economic rights infringement case involving the sketch. This research employs a qualitative approach using normative legal research methods, incorporating statute and case approaches. Data was collected through library research, including legal documents, court decisions, and relevant literature. The study’s findings indicate that the resolution of the copyright infringement dispute over the Welcome Monument sketch was pursued through litigation. The court found that the Welcome Monument sketch was registered under Copyright Certificate No. 46190 in the name of the late Sena Meaya Ngantung. The court ruled that PT. Martina Berto was guilty of copyright infringement. However, the judge did not grant the claim for material damages of IDR 500,000,000 (five hundred million rupiah). Instead, the court ordered PT. Martina Berto to cease the distribution of cosmetic products featuring the Welcome Monument silhouette.
