Abstract

ABSTRACT Implementation of Prosecution Termination Based on Restorative Justice in Assault Cases at the Palembang District Attorney's Office (Case Study of Case Number: PDM-249/L.6.10/Eoh.2/05/2024) By DESI ARSEAN Restorative justice arises due to dissatisfaction with the existing criminal justice system, which traditionally focuses only on the relationship between the state and the offender, without involving the conflicting parties. The issues addressed in this study are: 1) the implementation of Prosecution Termination Based on Restorative Justice in a Case of Assault at the Palembang District Prosecutor's Office (Case Study No. PDM249/L.6.10/Eoh.2/05/2024), and 2) the factors influencing the termination of prosecution based on restorative justice in the same assault case. This research is normative and conducted through a literature study. The results of the study show that the implementation of prosecution termination based on restorative justice in the assault case at the Palembang District Prosecutor's Office has been carried out effectively, with a structured process that involves the interests of the victim, the offender, and society. By following the steps outlined in Regulation of the Indonesian Attorney General's Office No. 15 of 2020, which includes case evaluation, victim willingness, mediation, and agreement documentation, it has proven to be an effective alternative for resolving criminal cases in a more humane and restorative way. Furthermore, 2) the factors influencing the prosecution termination based on restorative justice in the assault case at the Palembang District Prosecutor's Office refer to the theory of justice, particularly factors such as the victim's willingness to forgive, the role of mediation, reparations made by the offender, the severity of the crime, the social and economic background of the offender, and the offender’s commitment to change. These factors are interrelated and support the principles of utilitarianism, which emphasizes achieving the greatest benefit for all parties involved, including the victim, the offender, and society
