Abstract

ABSTRACT LEGAL CONSEQUENCES OF THE ENACTMENT OF LAW NUMBER 3 OF 2020 ON MINERAL AND COAL MINING IN THE MANAGEMENT OF MINERAL AND COAL MINES AT THE REGIONAL LEVEL CHAHAYA DEWI BIDARI Law Number 3 of 2020 on Mineral and Coal Mining has changed the mining management system in Indonesia, particularly regarding the authority of local governments. Previously, local governments played a role in licensing and supervising mining activities. However, with the enactment of this law, most of these authorities have been transferred to the central government. This shift has led to various legal implications for local governments in managing mineral and coal resources. Based on these issues, this study formulates two main research questions: (1) What are the legal consequences for local governments in managing mineral and coal mining since the enactment of Law Number 3 of 2020 on Mineral and Coal Mining? and (2) How is the supervision mechanism for mineral and coal mining management implemented after the enactment of Law Number 3 of 2020 on Mineral and Coal Mining? This research employs a normative juridical method with a literature study approach and interviews with relevant stakeholders. The study analyzes the prevailing laws and their implementation in local governance practices. The findings reveal that the transfer of authority from local to central government limits regional involvement in mining management, potentially reducing the effectiveness of supervision and public participation in natural resource governance. While this change aims to enhance efficiency and legal certainty in the mining sector, its implementation presents new challenges in achieving fair and sustainable policies. Therefore, a stricter oversight mechanism is necessary to ensure that mining management remains transparent, accountable, equitable, and continues to serve the interests of the public.
