Abstract

ABSTRACT THE LEGAL CONSEQUENCES OF THE RELIGIOUS COURT DECISION NUMBER: 39/PDT.P/2024/PA.PLG ON THE PROCESS OF LIFE INSURANCE CLAIMS BY GUARDIANS OF MINORS AT PT. PRUDENTIAL LIFE ASSURANCE By LIA DESTA ANGGRIANI Every determination made by the Religious Court had legal consequences for a disputed matter. This research aimed to analyze and explain: How did the legal consequences of the Religious Court's determination in Palembang Number: 39/Pdt.P/2024/PA.PLG affect the process of submitting life insurance claims by the guardians of minors at PT. Prudential Life Assurance? Did the Religious Court's determination in Palembang Number: 39/Pdt.P/2024/PA.PLG influence the process of submitting life insurance claims by the guardians of minors at PT. Prudential Life Assurance?. This research was a empirical data obtained through interviews. The data sources used in this research consisted of secondary and primary data. The research approach employed both legislative and case approaches. Based on the research findings, it was discovered that. The legal consequences of the Religious Court's determination in Palembang Number: 39/Pdt.P/2024/PA.PLG regarding the process of submitting life insurance claims by the guardians of minors at PT. Prudential Life Assurance were that the applicant obtained legal certainty as a legitimate guardian under the law, allowing them to act both inside and outside the court in the process of submitting life insurance claims at PT. Prudential Life Assurance. The Religious Court's determination in Palembang Number: 39/Pdt.P/2024/PA.PLG could significantly influence the process of submitting life insurance claims by the guardians of minors at PT. Prudential Life Assurance, as it became binding evidence with legal force after the court's appointment of a guardian, obliging the insurance company to provide the rights of the child represented by the applicant as a beneficiary from the deceased policyholder.
