Abstract

ABSTRACK There is nothing in the Civil Procedure legal process that regulates when the Plaintiff's absence has entered the subject matter / Proof of what the legal consequences are, however there are things that regulate how when the Defendant has submitted an answer to the Plaintiff's lawsuit. Whereas the purpose of Article 271 Rv is to protect the legal interests of the Defendant so that it does not become the Plaintiff's game. The problem is; 1. How Legal Consequences of the Plaintiff's Absence in the First Session of a Civil Case? 2. How Legal Consequences of the Plaintiff's Absence at a Civil Case Trial on the Evidence Agenda (Case Study of Case Decision No. 80/Pdt.G/2020/PN.Plg)? the type of research is normative legal research which is descriptive in nature and does not intend to test hypotheses. Secondary data collection techniques focused on library research (library research). Based on the results of the study, it can be concluded that due to the law if the plaintiff is not present at the first trial of a civil case, the plaintiff's lawsuit is dropped, this is in accordance with Article 124 HIR, the plaintiff can still file another lawsuit. Then the Legal Consequences of the Plaintiff's Absence at the Civil Case Session in the Evidence Agenda (Case Study on Case Number: 80 / Pdt.G/2020/PN.Plg is when after the answering process the Plaintiff wants to withdraw his lawsuit, on this the Defendant objected, After The revocation was rejected by the Defendant, then the Panel of Judges continued the trial on the Evidence agenda.
