Abstract

Hospital is one of the health facilities that serves as a gathering place for multidisciplinary health professionals dominated by doctors and nurses in providing services with efforts to promote health, promotion, prevention, curative and rehabilitative services. These efforts at the hospital must be the best service to patients, where it can be accepted, achieved, comprehensive, continuous and quality in order to achieve optimal health. The main issues discussed in this thesis are: What is the Hospital's responsibility for negligence of nurses in carrying out the delegation of doctor authority? And how is the mechanism for delegating doctor authority to nurses? This study is descriptive with a normative juridical approach, data collection uses secondary data consisting of primary, secondary and tertiary legal materials regarding the delegation of doctor authority to nurses in hospital health services so as to provide a clear legal picture. Based on the results of the study concluded that: 1. Hospitals as providers of health services are responsible for all legal consequences that arise as a result of their actions or the actions of others who are in their responsibilities including negligence of nurses in carrying out the delegation of doctors authority; 2. The mechanism for delegating doctor authority to the nurse has not been clearly regulated how the Standard Operating Procedure delegates the authority and the types of certain medical actions so that there is still overlap between the tasks of nursing care with the assignment of delegating doctor authority. As a recommendation, it is recommended that the government make clear Standard Operating Procedures in delegating doctors authority to nurses to avoid overlapping tasks so there is no part is harmed, especially nurses.
