Abstract
This study aims to analyze the Indonesian positive legal framework governing the actions of digital nomads who utilize visit visas to engage in work activities as a form of misuse of residence permits, as well as to examine the forms of criminal liability arising from such violations. The research employs an empirical juridical method with a qualitative approach, through the study of statutory regulations and field data obtained from interviews conducted at the Class I Immigration Office TPI Palembang. In addition, this study also considers the growing phenomenon of digital nomads, which has significantly increased along with the advancement of information and communication technology, enabling individuals to work remotely without being tied to a specific geographical location. The results indicate that there is currently no specific regulation concerning digital nomads in Indonesia. However, the use of a visit visa for the purpose of working can be legally classified as a misuse of a residence permit under Law Number 6 of 2011 concerning Immigration, particularly Article 122 letters (a) and (b). Criminal liability may be imposed on offenders in the form of imprisonment and/or fines, along with administrative immigration measures such as deportation, deterrence (blacklisting), and revocation of residence permits. In practice, immigration authorities also face various challenges in supervision and enforcement, particularly in proving work activities carried out online. The evidentiary process in handling such cases is conducted using both conventional and electronic evidence, while taking into account essential elements such as intent (mens rea) and legal facts including locus delicti and tempus delicti. Therefore, it is necessary to strengthen regulatory frameworks and enhance inter-agency coordination in order to provide legal certainty and improve the effectiveness of immigration law enforcement in Indonesia, especially in addressing the continuously evolving phenomenon of digital nomads.
