Abstract
Illegal coal mining (PETI) is a serious problem in Indonesia, especially in South Sumatra, causing state losses, environmental damage, and social conflict. This phenomenon violates the Mineral and Coal Mining Law, with thousands of illegal locations threatening the sustainability of natural resources and the community's right to a healthy environment as guaranteed by Article 28H of the 1945 Constitution. This study aims to analyze the criminal liability of PETI perpetrators in Decision Number 30/Pid.Sus-LH/2025/PN Mre and identify the judge's legal considerations in sentencing. Normative legal research with a regulatory and contextual approach, using secondary data in the form of primary legal materials (Minerba Law, Criminal Code, court decisions), secondary (books, journals), and tertiary. Data collection techniques through literature studies, explained descriptively-analytical deductive. The perpetrators were proven to have violated Article 158 of Law No. 3/2020 in conjunction with Article 55 paragraph (1) point 1 of the Criminal Code through complete proof of the subject elements, acts of mining without a permit (PIT, heavy equipment, stockpiling), intentional, and without any excuse, with a penalty of 4 years imprisonment and a fine of IDR 50,000,000,000. The judge's considerations include legal considerations, namely (alternative charges, evidence from witnesses/experts/documents/items, approval of Article 161) and non-legal considerations (aggravating factors, namely state losses, environmental damage, and mitigating factors, namely admission of the act), so that the sentence is proportional and supports the enforcement of environmental criminal law.
