Abstract

ABSTRACT LEGAL STATUS OF INSTALLATION OF ELECTRONIC DETECTION EQUIPMENT AGAINST CHILD SEXUAL CRIMES By ADE TIARA FEBRIANI The background in this research is that there is an additional punishment in the form of installing an electronic detection device which is still not clear how to execute and apply it to perpetrators of sexual crimes against children. The formulation of the problem in this study is 1) What is the legal status of the installation of electronic detection devices against perpetrators of sexual crimes against children? and 2) How is the installation of electronic detection devices against perpetrators of sexual crimes against children in terms of human rights?. The research method used is normative juridical research. Sources of data used in this study consisted of secondary data. Based on the results of the study, it shows that the legal status of installing electronic detection devices against perpetrators of sexual crimes is legalized in the eyes of the law and used as a second form of imprisonment for perpetrators as stated in Law No. 23 of 2002 concerning Child Protection which is legalized in the eyes of the law which is a sanction Action that is a new breakthrough in the legal system in Indonesia and 2) Installation of electronic detection devices against perpetrators of sexual crimes against children from the perspective of the perpetrators' human rights, the application of installation of tools Electronic detectors as stipulated in Article 81 paragraph (7) of Law Number 17 of 2016 are a form of human rights abuse. Sanctions for installing electronic detection devices, this action is proven to be a form of punishment that is inhuman and degrading and violates a person's right to privacy. This is considered to have contradicted the human rights contained in positive law in Indonesia as stated in Article 28B paragraph (1), 28G paragraph (2), Article 28G paragraph (1), Article 28I paragraph (1) of the 1945 Constitution.
